Agreeing to these terms

By creating an account, you agree to these Terms. If you're using Kanchito on behalf of a league, club, or organization, you're confirming you have the authority to agree to these Terms on its behalf.

Kanchito is currently in beta. Features, pricing, and availability may change as the product develops.

1. Who these terms apply to

These Terms are between Kanchito and tournament directors ("TDs") who create an account to run events on the platform. TDs must be 18 or older.

Players and spectators who register for an event through a public event page don't create a Kanchito account and aren't a party to these Terms. Their relationship is with the TD running that event. Section 8 below describes what players are agreeing to when they register.

2. What Kanchito is (and isn't)

Kanchito is software that helps TDs run tournaments: registration tracking, pool play and bracket scheduling, and live results pages. Kanchito does not organize, sponsor, referee, insure, or take responsibility for the events themselves. The TD is solely responsible for their event, including:

• Venue arrangements, safety, and on-site supervision
• Collecting any liability waivers required for participation (Kanchito does not collect, store, or provide waivers, see our Privacy Notice)
• Handling payments from players (currently peer-to-peer, outside the platform)
• Accuracy of event details, rules, and prizes
• Compliance with any applicable local, state, or sport-governing-body requirements

3. Your account

You're responsible for keeping your account credentials secure and for all activity under your account. Let us know right away at Leo@Kanchito.com if you believe your account has been compromised.

4. Content you submit

You retain ownership of the event details, rosters, and other content you submit to Kanchito. By submitting it, you give us permission to store, display, and process it as needed to operate the platform, for example showing your event's public roster page to visitors.

You're responsible for making sure you have the right to submit any content you upload (including player names and info) and that doing so doesn't violate anyone else's rights.

5. Fees

Kanchito is currently free to use during beta. If we introduce paid features or pricing in the future, we'll notify account holders in advance and update these Terms accordingly. Any payments between TDs and players that happen outside the Kanchito platform (e.g. Venmo, Cash App) are solely between those parties. Kanchito is not involved in and has no responsibility for those transactions.

6. Disclaimers

Kanchito is provided "as is" and "as available," without warranties of any kind, express or implied. As a beta product, we don't guarantee uninterrupted access, error-free operation, or that data will never be lost. We recommend keeping your own copies of critical event information.

Kanchito is software only. We are not responsible for what happens at your event, including injuries, disputes, weather, venue issues, or anything else arising from the tournament itself. That responsibility sits with the TD organizing the event.

7. Limitation of liability

To the fullest extent permitted by law, M&N Studio LLC and its founders won't be liable for any indirect, incidental, or consequential damages arising from your use of Kanchito. Our total liability for any claim relating to the platform is limited to the amount you paid us (if any) in the 12 months before the claim arose.

8. Event participants (players)

If you register for an event through a Kanchito event page, you're agreeing that:

• You are 18 or older. Kanchito is not intended for use by minors, and we do not knowingly allow minors to register as players.
• The tournament director running the event, not Kanchito, is solely responsible for the event, its safety, and any waivers required to participate
• Information you submit (such as your name and position) may be displayed publicly on the event's roster page, visible to anyone with the event link
• Any payment for the event happens directly between you and the TD, outside of Kanchito

9. Our content and trademarks

The Kanchito name, logo, mascot, and platform design are owned by M&N Studio LLC. Your license to use Kanchito is limited to accessing the platform for its intended purpose, running and participating in tournaments. You may not copy, reproduce, or reuse Kanchito's branding, design, or platform materials outside of that use without our written permission.

10. Acceptable use

When using Kanchito, you agree not to submit content (event names, descriptions, roster entries, or anything else) that is illegal, harassing, threatening, hateful, obscene, or that violates someone else's rights. We may remove content or suspend access for violations of this section, and we'll make reasonable efforts to give notice first except in serious or repeated cases.

11. Indemnification

You agree to indemnify and hold Kanchito harmless from any claims, damages, or expenses arising from your use of the platform, your event, or your violation of these Terms, except where caused by our own gross negligence or willful misconduct.

12. Termination

You can stop using Kanchito at any time. We may suspend or terminate an account that violates these Terms or misuses the platform. We'll make reasonable efforts to give notice first, except in cases of serious or repeated violations.

13. Changes to these terms

We may update these Terms as Kanchito develops. We'll update the date above when we do, and for material changes, we'll make a reasonable effort to notify active account holders.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas. Any disputes will be resolved in the state or federal courts located in Bexar County, Texas, and you agree to that venue.

15. Severability

If any provision of these Terms is found unenforceable, that provision will be considered separate from the rest, and the remaining Terms will stay in effect.
